This thesis has the title ''Criminal Accountability of the Regent as Perpetrator'' The Crime of Gratification of the Palembang District Court Decision Study Number 32/Pid.Sus TPK/2019/PN.Plg''. The background behind the writing of this thesis are: the emergence of corruption cases that often occur among regional officials which results in loss to the state. One form of corruption What is done is gratification. The problems raised in this writing to see what the judges consider in imposing sanctions criminal acts as well as how the criminal responsibility of perpetrators of criminal acts of corruption The Regent as the perpetrator of the criminal act of gratification (Study of the Palembang District Court Decision No 32/Pid.Sus-TPK/2019/PN.Plg) when viewed from a sentencing point of view. The research method used is a type of normative legal research. From the research results show that the judge in making a decision considers both aspects juridical and non-juridical aspects where the defendant legally and convincingly has violates Article 12 letter a of Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 concerning amendments to Law Number 31 1999 concerning Eradication of Criminal Acts of Corruption Jo Article 55 paragraph (1) to 1 Jo Article 64 paragraph (1) of the Criminal Code. From this writing it can be concluded that in sentencing, the judge has paid attention to all forms of related aspects with the subject matter so that the decision is in accordance with the theory of imposing sanctions. The regent's criminal responsibility as the perpetrator of the criminal act of gratification if: from the point of view of punishment, it has been based on a combined theory based on the principle of retaliation and the principle of defense of public order.
