PENYELESAIAN HUKUM PEMBUATAN AKTA PERJANJIAN PENGIKATAN JUAL BELI RUMAH SECARA GANDA (Studi Kasus : Putusan Nomor 174/Pid.B/2018/PN DPS)
This studies aims at analyzing (1) the legal responsibilities of the notary regarding the making of multiple binding deed of sale and purchise (PPJB) of house and (2) the legal settlement of the dispute over the making of the multiple deed. It is a normative research using primary, secondary and tertiary legal materials. Multiple PPJB is currenly a fairly complicated problem and it accurs in the community. Its has the potential to cause problems and great losses. The result of this study confirm that concerning the multiple PPJB, the notary is fully responsible if he participle or is the mastermind of the unlawful act as he has deliberately carried out an act of deceit to benefit himself agains the law. For the action, the Notary involved can punished and be held accountable either criminally, civilly and/or administratively. The settlement of land disputes made with multiple PPJB and causing losses to the parties must be resolved by giving appropriate punishments to the perpetrators, It can be done by means of litigation, i.e., taking legal channels through trials in court, and/or by using-non litigation channels, i.e. by means of mediation, deliberation and or arbitration in order to provide mutually beneficial decisions for the parties.
