One of the activities in economic development is the procurement of goods and services aiming at obtaining goods or services needed at the best price. The procurement of goods and services is inseparable from business competition between business actors. Law in Indonesia has regulated business competition in Undang – undang Nomor 5 tahun 1999 concerning Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. However, there are rules regarding direct appointments to other State-Owned Enterprises (BUMN) in the Regulation of Menteri BUMN Nomor Nomor PER-08/ MBU/ 12/ 2019 concerning Pedoman Umum Pelaksanaan Pengadaan Barang dan Jasa Badan Usaha Milik Negara. This needs to be examined from the viewpoints of business competition law. The issuance of this Ministerial regulation has legal and practical implications for the procurement of goods and services at PT Semen Baturaja (Persero) Tbk where as a BUMN, it is mandate to obey the Ministerial Regulation. This study uses normative legal research. It was concluded that : 1. From a judicial aspect, direct appointment to other BUMN violated the principle of fair business competition as regulated in Undang – undang Nomor 5 tahun 1999. 2. Regulation of Menteri BUMN Nomor PER-08/ MBU/ 12/ 2019 had juridical and practical implications for the procurement of goods and services at PT Semen Baturaja (Persero) Tbk. 3. The role of the Business Competition Supervision Commission (KPPU) needed to be increased in the procurement of goods and services in BUMN.
