PERANAN NOTARIS DALAM PERJANJIAN PEMBIAYAAN BERDASARKAN PRINSIP IJARAH MUNTAHIYAH BITTAMLIK (IMBT) DALAM PERSPEKTIF HUKUM ISLAM DAN LEMBAGA LEASING DALAM PERSPEKTIF HUKUM PERDATA
The dual banking system in Indonesia affects the implementation of banking products. One of the banking products is lease financing which has different regulations. The financing agreement requires the role of a notary in order to have legal force. This study examined the role of notaries in financing agreements based on the principle of Ijarah Muntahiyah Bittamlik (IMBT) in the perspective of Islamic law and the leasing institutions in the perspective of civil law. This study compared the essential financing in IMBT principles with the perspective of Islamic law and the leasing institutions with a civil law perspective, the prodecure for making IMBT Islamic financing deeds in Islamic law and the leasing in the civil law, the role of notaries in the making of IMBT financing contracts in Islamic law and the leasing in the civil law. This study was normative based on the legal certainty theory, position theory, authority theory, load-bearing balance theory, rights transfer theory. The legal materials used primary, secondary, and tertiary legal materials. This legal study used historical, statutory, comparative, and case approaches. The results of the study showed that in practice the implementation of IMBT financing was not in accordance with the existing regulations because it still followed the implementation of leasing financing. The preparation of sharia deeds followed the format of the Financial Services Authority regulations, yet there was no specific format for the IMBT financing deed. The making of a leasing deed was based on an agreement in accordance with the Civil Code. The role of a notaryin order to make a sharia deed was to become a partner of sharia bank and had a special certificate of a notary organization.
