Land rights is an object which common to be used as a grant agreement by public, where the land right grant must be done with authentic deed created by land titles registrar. Before grant is started, the grant giver must pay attention into the fairness and openness point toward the heirs. Therefore based on Islamic jurist, muslim grant must be aligned with the islamic law compilation (KHI), Al Qur’an guidance, and the direction from Islamic prophet Muhammad SAW. The aim for this research is to analyze and describe the rule of grant deed validity of a land right to one of prospective heirs without an endorsement from other heirs based on islamic law compilation with referring decision of Polewali religious court no 119/Pdt.G/2018/PA/Pwl which cancel the grant deed given from a parents as the grant giver into the grant receiver as the prospective heirs without an endorsement from other heirs, and land titles registrar role in preventive dispute on the land rights transfer process without any agreement from other prospective heirs. The methodology used in this research to observe bibliograph availability is based on juridical normative research while the research approach are reffering to legistation, conceptual, analysis, and study case approach. As the research result, the grant in Islamic law compilation is limit the grant giving into 1/3 from the possessions while the grant giving which exaggerate could be calculated as inheritance. Despite of PPAT deed have a complet proof for the grant deed, the land right could be cancelled through of court decision if any related parties raise their objection. Referring the study case of Polewali religious court no 119/Pdt.G/2018/PA/Pwl, the court is cancelling the grant deed because the grant asset is the only inheritance left, and the value are more than 1/3 total asset which not aligned with Islamic law compilation and guidance stated in Al Qur’an that taught about the fairness in assest distribution to the heirs since the purpose of the grant giving is to create a merit and not to create any sin. The PPAT Role in giving the grant deed must be attach additional requirement such as agreement letter from other heirs to avoid any family dissension because of inheritance.
