TANGGUNG JAWAB PEJABAT PEMBUAT AKTA TANAH TERHADAP PERBUATAN MELAWAN HUKUM
PPAT or Land Deed Official based on Government Regulation Number 37 of 1998 about regulations for the position of Land Deed Official is a public official who is authorized to make authentic deeds regarding certain legal actions regarding land rights or property rights of apartment units. In carrying out the authority, PPAT must comply with the applicable regulations. But in implementation, it still often happens that PPAT doesn’t comply with the regulations so that PPAT can be categorized as unlawful acts. This thesis discusses about PPAT’s responsibility for unlawful acts which is detrimental the parties and consequence to PPAT who commit unlawful acts and detrimental the parties. This study uses normative research methods using statute, case and conceptual approaches. The result of this study showed that PPAT’s responsibility for unlawful acts which is detrimental the parties can by civil responsibility and administrative responsibility. Civil responsibility based on Article 1365 of the Civil Code is reimbursement or compensation; administrative responsibility based on Article 62 Government Regulation Number 24 of 1997 about Land Registration is written warning, temporary dismissal, dismissal with respect and dismissal with disrespect and consequence to PPAT who commit unlawful acts and detrimental the parties the deed PPAT’s become null and void.
