This research is entitled The Application of Additional Penalty in Lieu of State Financial Losses in the Crime of Corruption Based on Supreme Court Regulation Number 1 of 2020 concerning Sentencing Guidelines for Article 2 and Article 3 of the Corruption Eradication Law (Study of Decision Number. 65/Pid.Sus-TPK/2023/PN Plg, Decision Number 8/Pid.Sus-TPK/2018/PN.JKT and Decision Number 58/Pid.Sus-tpk/2023/PN.Sby.) corruption cases that harm state finances are widely practiced and there are often disparities in punishment. This research is normative legal research collected through literature study. The results of this study indicate that, to overcome the disparity, PERMA No. 1 of 2020 was issued. although there are sentencing guidelines for related offenses, the judge's consideration is not in accordance with the guidelines for determining the size of the punishment imposed by considering the level of guilt, impact, and profit. Therefore, in order to make the implementation of the guidelines for the imposition of restitution punishment more effective, the Supreme Court Circular Letter (SEMA) concerning the guidelines for subsidiary imprisonment related to the imposition of restitution punishment as well as sanctions against judges who are not guided by these rules.
