PERAN NOTARIS DALAM PROSES ALIH KREDIT PEMILIKAN RUMAH (KPR) SUBSIDI PADA PT. BANK TABUNGAN NEGARA (PERSERO) TBK CABANG UTAMA KOTA PALEMBANG
The writing of this thesis is motivated because in practice there is often a legal smuggling of transferring ownership of subsidized mortgages that have only been occupied by debtors for a period of less than 5 years. This is contrary to the provisions of Article 22 paragraph (3) letter b of Permen PUPR No. 35 of 2021. This study aims to determine the role of the Notary and the characteristics of the deed used by the Notary in the process of transferring subsidized Home Ownership Loans (KPR) at PT.Bank Tabungan Negara (Persero) Tbk Main Branch Palembang City. This research is a type of Normative research using library research material collection techniques which will then be analyzed qualitatively using a statutory approach and conceptual approach. The results of this thesis research show that the role of Notary in the process of transferring subsidized home ownership loans (KPR) at PT BTN, the main branch of Palembang city, namely the making of deeds of novation and power of attorney to charge mortgage rights (SKMHT) by prioritizing the principles of expediency and balance. The characteristics of the deed used in the process of transferring subsidized mortgages at PT BTN, the main branch of Palembang, namely using an authentic deed with the type of Partij deed and a form that is in accordance with the provisions of Article 38 of the Notary Office Law which in the deed covers the interests of the parties in a balanced manner.
