PERLINDUNGAN HUKUM BAGI NOTARIS TERHADAP AKTA OTENTIK YANG MEMUAT KETERANGAN PALSU DARI PARA PIHAK (Studi Kasus Putusan Pengadilan Negeri Bandung Nomor 606 K/Pid/2016)
ABSTRACT Notary in carrying out his position as a public official who has the authority to make authentic deeds cannot be separated from problems regarding making authentic deeds, as well as interested parties in making authentic deeds. In this case, the parties giving false information to the Notary when making an authentic deed which causes problems. Therefore, the Notary must protect themselves to avoid problems in the authentic deed made by the Notary in the future. This research aims to analyze and understand legal protection for Notaries regarding the information of the parties which is not appropriate in making an authentic deed, as well as analyzing and understanding the legal consequences of parties who provide false information in making authentic. The method used in this study is normative research by using a statutory approach, conceptual approach, and case approach. The results of this research indicate that legal protection for Notary is by following all applicable procedures as determined by statutory regulations, as long as the notary has implemented procedures in accordance with applicable regulations with the principle of prudence, Notary compliance with Notary Position Act (UUJN), validating the data of the adapting parties, and the Notary's understanding of the law. Meanwhile, the legal consequences for parties who provide false information in making an authentic deed to a notary are based on the Indonesian Criminal Code Article 266 which is linked to Article 55 of the Indonesian Criminal Code, legal consequences based on the Indonesian Civil Code Article 1365, and Article 1366.
