Article 22 of Regulation of Minister of Law and Human Rights No. 5 of 2020 explains that legal facts examination on allegation of Notary violation from public reports, shall be implemented based on final court decisions. There were several cases where Regional Supervisory Council provided recommendations to Local Supervisory Council based on reports from public on Notaries, during judicial process and final court decision is not yet issued. Decisions issued by the Local Supervisory Council in the form sanction recommendation in this case is a temporary dismissal read in an open public court. The recommendations often times are used by informants to ruin Notaries’ credibility. The problem raised in this study is how the legal status of Notaries position is after being imposed by sanctions in the form of temporary dismissal recommendation by the Supervisory Council of Notaries and legal efforts of Notaries in recovering reputation after court decisions declaring their innocence but sanction recommendations by the Supervisory Council of Notaries have been given. This study is a normative law research, implemented under laws and regulations by researching library materials or secondary data. Notaries imposed with temporary dismissal sanction recommendations by the Supervisory Council of Notaries can still carry out their job as stated in the Law of Notary Post until a final decision on temporary dismissal is issued by the Central Supervisory Council. Notaries may apply for objection and appeal on the decision of the Local Supervisory Council containing temporary dismissal sanction recommendation to the Notaries by referring to the final court decision. A specific regulation on reputation recovery and compensation suffered by Notaries who based on court decisions are declared innocent is necessary as a form of effort and accountability of the Supervisory Council of Notaries for the imposition of sanction decisions.
