PENEGAKAN HUKUM DALAM PROSES KEMITRAAN UMKM OLEH KOMISI PENGAWAS PERSAINGAN USAHA (KPPU)
Micro, Small, and Medium Enterprises (MSMEs) play a strategic role as drivers of inclusive and sustainable economic growth. In practice, MSMEs are often in a weak or unbalanced position when entering into partnerships with large companies. This imbalance of power allows large businesses to abuse their dominant position, ultimately causing losses for MSMEs. In this case, the Business Competition Supervisory Commission (KPPU) plays an important role in ensuring that MSME partnerships remain within the corridor of fair business competition principles in accordance with Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The focus of this study is on indicators of MSME partnerships that violate fair business competition, the legal consequences of such violations, and the KPPU's efforts to ensure that MSME partnerships are conducted within the legal framework of fair business competition. The research method used is the Normative Method with a Prescriptive Qualitative approach. Primary legal materials include Law Number 5 of 1999 concerning Prohibition of Monopoly Practices and Unfair Business Competition, Law Number 20 of 2008 concerning MSMEs, and other implementing regulations. The analysis was conducted using the supervision theory, the per se illegal approach theory, and the rule of reason. The results of the study show that the indicators of MSME partnerships that violate fair business competition are abuse of dominant position by large businesses, discriminatory practices in providing facilities or unfair treatment of one party in the partnership, restriction of market access, and unauthorized use of information. The legal consequences of these violations include administrative sanctions, fines, and even revocation of business licenses. Meanwhile, KPPU has taken various preventive and repressive measures to ensure that MSME partnerships are conducted within the framework of fair business competition.
