The reading of the deed by the Notary is a must in making an authentic deed, the reading of the deed is part of the verlijden or inauguration of the deed. In practice, the Notary overrides the process of reading the deed when formalizing the authentic deed he made, even though this can have legal consequences for the deed, namely causing losses to the parties, especially for the faces and intrumenter witnesses. The purpose of this study is to determine and analyze the validity of authentic deeds that are not made in front of a notary and the form of legal protection for the faces and notary witnesses in making authentic deeds not in front of a notary. This research is a normative research using primary, secondary and tertiary legal materials. From the results of the research, it is known that based on UUJN and Kuhperdata, the reading of the deed that is not carried out by a notary in the process of making an authentic deed causes the deed to become an underhand deed so that it does not have validity as an authentic deed. The form of legal protection for the face of the loss due to the non reading of the deed is by filing a lawsuit to the court against the notary in the form of compensation, while the legal protection for instrumental witnesses is still guided by the Law on the protection of witnesses and victims in general, where this protection is not sufficient to provide protection to instrumental witnesses. A law is needed that specifically regulates the legal protection of Notary employees as instrumental witnesses for the actions of notaries who do not read the deed in the process of making authentic deeds as determined by the UUJN so that later the position of instrumental witnesses can be more secure.
