Illegal drilling is not a new issue in Indonesia. Rather, it has been a recurring issue for years and remains unresolved to this day. It negatively impacts not only the Indonesian economy but also the surrounding environment. Based on the above description, the legal issues discussed in this thesis are as follows: 1) How is the law enforced against perpetrators of illegal oil drilling in old oil wells within the working area of PT. Pertamina Persero in South Sumatra?; 2) Is PT. Pertamina Persero also responsible for the impacts of illegal oil drilling in old oil wells within its working area?; and 3) How should illegal drilling be regulated in the future to create a deterrent effect for perpetrators? The research method used in this study is normative research. The results of this research conclude the following conclusions: 1) Law enforcement against perpetrators of illegal oil drilling in old oil wells within the working area of PT. Pertamina Persero in South Sumatra has been carried out as it should, and currently A Special Oil and Gas Task Force (Satgas MIGAS) has also been formed to carry out both preventive and repressive measures, although these efforts have not yet been effective. 2) PT. Pertamina Persero also shares responsibility for the impacts caused by illegal oil drilling in old wells in its working area. 3) Regulations on Illegal Drilling in the future to address the crime of illegal drilling must include regulations containing affirmations regarding legal qualifications, provisions regarding repeat criminal acts or recidivism, corporate liability, and types of criminal sanctions, including both penal and corrective actions.
