The implementation of the deposit of compensation for land acquisition for the construction of the Inderalaya-Prabumulih toll road in a state where the land is still in dispute over ownership, experiencing obstacles from legal substance factors is legal substance factors, namely the Land Acquisition Law which does not contain an explanation of the article explaining regarding when compensation is requested by the instance requiring the land to the Court, so that it has an impact on the obstacle of land acquisition officials who interpret that the deposit can be carried out even though the lawsuit from another party is filed after the stages of implementation of land acquisition. The next obstacle is from the legal culture factor related to legal awareness, where after knowing about the deposit, the Plaintiff then sues the entitled party repeatedly, while never being able to prove legal control or ownership. In the future, it is necessary to reformulate the explanation of Article 42 paragraph (2) letter b numbers 1, 2, 3, and 4 of the Land Acquisition Law, from the beginning being quite clear, to essentially explaining that the deposit of compensation for land acquisition objects to the Court according to four specific circumstances, including deposit if the land acquisition object is in dispute over ownership, is carried out if the circumstances occur before the stages of land acquisition. Through the explanation of this article, if the condition has not occurred or occurs after the land acquisition implementation stage, then compensation must be submitted directly to the entitled party, without deposit. The reformulation also includes the addition of paragraph (paragraph (3)) to Article 24 of the PerMA on Deposit of Compensation, with similar reformulation regulations.
