This study discussed the application of the principle of dominus litis by the Publics Prosecutor indetermining the from settlement og narcotics abuse cases, especially ini choosing betwen criminalization or rehabilitation for perpetrators. In the Indonesian criminal justice system, the principle ogf dominus litis gives full authority to the presecutor as the controller of the case to determine the direction of the prosecution policy, including considering the restorative justice approach and rehabilitative goals for drug abusers. This study used a normative-empirical approach method. The normative approach was carries out by examining laws and regulations such as Law number 35 of 2009 concering Narcotics, the criminal Procedure Code, and the Attorney General's Guidelines Number 18 0f 2021. Meanwhile, the empirical approach was carries out throught field studies at the South Sumatra High Presecutor's Office and District Attorney's Office in their jurisdictions, with the interview, observation, and case data documentation techniques for 2022-2024. The results of the study shoe that the implementation og the principle of dominus litis by the presecutor has not been optimal in directing the settlement of the cases to the legal rehabilitation pathway. Most prosecutors still tended to cgoose criminality, even thought the perpetrator already met the qualifications as a victim of narcotics abuse based on the results of an integrated assessment. This is due to a number of factors, including limited understanding of the concept of restorative justice, limited rehabilitation facilities, lack of sychonization betwen law enforcement agencies and performence orientation that is stil based on the quality of case handling. The application of the principle of dominus litis hasgreat potential to support the reform of the narcotics case handling system that is more humane and recovery-oriented. However, it is necessary to trenghthen tecnical regulations, increase the capacity of presecutors, and develop a coordination system betwen agenciies in a sustainable manner so that the legal rehabilitative approach can be carried out consistenly and effectively.
