PENEGAKAN SANKSI ADMINISTRATIF TERHADAP PEJABAT PEMBINA KEPEGAWAIAN YANG MELANGGAR SISTEM MERIT DALAM MANAJEMEN APARATUR SIPIL NEGARA
This research analyzes the legal basis and enforcement mechanisms for administrative sanctions against violations of the merit system by Civil Service Officials in the management of the Civil Service in Indonesia, particularly following the enactment of Law No. 20 of 2023. This study employs a normative legal research method, aiming to examine the provisions regarding sanctions in the aforementioned law and the procedures for their enforcement. The results of the study indicate that the legal basis for the enforcement of sanctions is derived from Law No. 30 of 2014, Government Regulation No. 17 of 2020, and Presidential Regulation No. 116 of 2022, which regulate the authority of the National Civil Service Agency and the types of sanctions. However, a significant gap was found between the ideal normative regulations and the reality of implementation on the ground, primarily due to ambiguities in the legal basis for enforcement. Based on these findings, it is recommended that the government immediately draft a Government Regulation under Law No. 20 of 2023 that explicitly regulates the types and procedures for imposing clear and specific administrative sanctions on civil service supervisors who violate the merit system. Additionally, the follow-up mechanism for the National Civil Service Agency's sanction recommendations needs to be strengthened and strictly monitored by the President as the highest authority, to bridge the gap between recommendations and implementation, and to enhance the enforceability of the law and the effectiveness of sanction enforcement.
