PENYELESAIAN SENGKETA KONSTRUKSI ANTARA PERGURUAN TINGGI NEGERI BERBADAN HUKUM DENGAN MITRA KERJA MELALUI BADAN ARBITRASE
ABSTRACT The State College of Law (PTNBH) is a concept of State College which has the status of a legal body and has its own autonomy. This has resulted in PTNBH having the opportunity to bind itself in business contracts, especially construction. Does not exclude the possibility, that PTNBH will be involved in a construction dispute. Arbitration has the authority to examine and prosecute construction disputes under the Construction Services Act No. 2 of 2017, which requires the settlement of disputes to be carried out by mutual agreement and through the stages of mediation, conciliation and arbitration. This research is carried out with the method of Normative Law Research which will seek to answer several issues, among others: (1) Can Arbitration be an option for State College of Law bodies as an alternative to Construction Dispute Resolution?, (2) How is Cost and Benefit Construction dispute resolution through Arbitrating for College Law Bodies? (3) How is the Mechanism of Enforcement of the Arbitration Decision on Construction Disputes involving State Colleges of Law? The results of this study provide information that the PTNBH is an independent legal subject that can bind itself in an agreement and engage in a dispute, especially a construction dispute. As a construction dispute settlement option, arbitration has several advantages that will be very helpful to business actors such as clear dispute resolution times, final and binding judgments as well as a closed and confidential settlement process. Arbitral decisions, both national and international, must be registered for enforcement in accordance with the provisions of Section 59-69 of Act No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.
