LEGALITAS SURAT PERNYATAAN PELEPASAN HAK PENGUASAAN TANAH DI HADAPAN CAMAT DALAM PELAKSANAAN PENGADAAN TANAH UNTUK KEGIATAN PERTAMBANGAN BATUBARA OLEH BADAN USAHA MILIK NEGARA
Land acquisition for coal mining activities by state-owned enterprises (BUMN) cannot be categorized as public interest, so its implementation is business to business based on civil law in the form of purchase agreements. In practice, it is carried out through a statement of release of rights (Surat Pernyataan Pelepasan Hak/ SPPHT) made before a district head. However, it creates legal uncertainty because the statement is not an authentic deed, leading to doubts about the legality of the document. Based on this issue, the formulation of the problem in this study is: 1) What is the procedure for land acquisition for coal mining activities by BUMN considering the legal role of a district head in drafting the SPPHT?; and 2) What is the legal standing and consequence of an SPPHT made before the district head, as analyzed from existing laws and regulations? This belongs to normative research using deductive reasoning approach. The results of the research show that the land acquisition procedure for coal mining activities by a state-owned enterprise (BUMN) with the involvement of a district head refers to the company's internal policies as an implementation of the principles of Good Corporate Governance. The legal status of the SPPHT, made before the district head, is a valid document because the district head is given authority which is an attribution of statutory regulations. The legal consequence is that the SPPHT is a private deed because it does not fulfill the elements of Article 1868 of the Civil Code concerning authentic deeds. This study recommends that companies should continue to coordinate with the regional government, the Ministry of ATR/BPN, and the Finance and Development Supervisory Agency (BPKP) in creating internal policies. The SPPHT made before district head does not have perfect evidentiary power because it is not an authentic deed. For stronger legal certainty, the statement of release of rights should be made before a notary. Keywords: land acquisition, st' ement of release of rights, coal mining
