Penelitian ini membahas banyaknya kasus penghilangan paksa yang terjadi secara global maupun nasional dan aturan hukum internasional yang mengaturnya. International Convention for the Protection of All Persons from Enforced Disappearance merupakan aturan hukum internasional yang disahkan pada tahun 2006. Konvensi tersebut menjadi dasar perlindungan terhadap hak setiap orang untuk terhindar dari tindakan penghilangan paksa. Tujuan penelitian dalam skripsi ini yaitu menganalisis perlunya undang-undang terkait kejahatan penghilangan paksa, menjelaskan norma-norma yang tercantum dalam konvensi, dan menjelaskan tindakan yang seharusnya dilakukan oleh Indonesia terkait kejahatan penghilangan paksa. Adapun metode penelitian yang digunakan adalah penelitian hukum normatif melalui pendekatan perundang-undangan, kasus, dan perbandingan. Hasil penelitian menunjukkan bahwa sejarah gelap kasus penghilangan paksa yang terjadi di dunia termasuk Indonesia menandakan bahwa jenis kejahatan ini perlu diatur dalam suatu aturan hukum yang mengikat. Norma-norma yang tercantum di dalam konvensi ini juga mengatur banyak perlindungan terkait korban dan keluarganya. Konvensi ini juga dapat diharmonisasikan ke dalam hukum positif di Indonesia setelah melakukan ratifikasi agar dapat diterapkan secara utuh. This research discusses the many cases of enforced disappearance that occur globally and nationally and the international legal rules that govern them. The International Convention for the Protection of All Persons from Enforced Disappearance is a rule of international law passed in 2006. The Convention is the basis for the protection of the right of every person to avoid enforced disappearance. The research objectives of this thesis are to analyze the need for laws related to the crime of enforced disappearance, explain the norms contained in the Convention, and explain the actions that Indonesia should take associated with the crime of enforced disappearance. The research method used is normative legal research through legislative, case, and comparative approaches. The results show that the dark history of enforced disappearance cases that occurred in the world including Indonesia indicates that this type of crime needs to be regulated in a binding rule of law. The norms contained in this Convention also regulate many protections related to victims and their families. This Convention can also be harmonized into positive law in Indonesia after ratification so that it can be fully implemented.
