KEDUDUKAN MONETISASI KONTEN YOUTUBE SEBAGAI OBJEK HARTA BERSAMA DALAM PERSPEKTIF HUKUM PERKAWINAN
The purpose of this study was to analyze the position of YouTube content monetization as an object of joint property in the perspective of Marriage Law, analyze about division of YouTube content monetization which is the object of a lawsuit in a dispute over the division of joint property in court, and to determine future regulations related to the position of YouTube content monetization as an object of joint property in the perspective of Marriage Law. The research method used in this study was normative legal research, which focuses on the study of laws and regulations, legal doctrines, and literature related to analyze the position of YouTube content monetization as an object of joint property in Indonesian marriage law. The approaches used include a statute approach to examine relevant laws and regulations and a conceptual approach to explore legal theories regarding joint property and digital assets. The results of the study showed that although income from YouTube content monetization can be considered as joint property obtained during marriage, there was a legal gap governing the status of digital assets in the context of property law in Indonesia. This study recommends the need for clearer regulatory updates regarding the regulation of digital assets in order to create legal certainty in the division of joint property, especially for couples involved in the profession as content creators.
