PENERAPAN PRINSIP KESETARAAN DALAM KONTRAK BISNIS WARALABA YANG DIBUAT DI HADAPAN NOTARIS
A Franchise agreement is stated in the form of a written agreement containing several standard clausa and additional that have been previously discussed between the two parties. It is reasonable to suspect that this standard agreement will not be able to provide an adequate sense of justice for the party in a weak position. In a contract, the equality of the parties must be considered, if the equality of the parties is set aside, then the contract does not reflect a balance and justice relating to the rights and obligations of the parties. Therefore, the problem in this thesis research is how to apply the principle of equality in a franchise business contract made before a Notary, the role and responsibilities of a Notary in a Franchise Business Contract, and the obstacles and solutions in applying the principle of equality to a Franchise Business Contract. This research used a normative legal research type regarding the application or implementation of normative legal provisions in every specific legal event that occurs in the community. The results of the study showed that the application of the principle of equality in franchise business contracts made before a Notary is an effort to ensure that the contract not only meets applicable legal provisions, but also creates a fair and balanced business relationship between the franchiser and the franchisee. Thus, contracts made before a Notary are not only legally valid, but also prioritize the principle of justice that is important in the business world.
