KEWAJIBAN TINDAK LANJUT TERLAPOR ATAS REKOMENDASI OMBUDSMAN DALAM PENGAWASAN PELAYANAN PUBLIK
This thesis is titled: The Obligation of the Reported Party to Follow Up on Ombudsman Recommendations in Public Service Oversight. This thesis is motivated by issues arising from misconceptions about the mandatory nature of Ombudsman recommendations in the law and the concept of recommendations in state administration. The issues discussed in this thesis are the basis for considering the obligation of the reported party to follow up on Ombudsman recommendations in public service oversight and the legal consequences of failing to fulfill the obligation of the reported party to follow up on Ombudsman recommendations in public service oversight. This research is a normative study using a conceptual legal approach. The discussion in this thesis concludes that the obligation to implement these recommendations is based on three main dimensions: philosophical, sociological, and legal. This is reflected in the values of compliance and moral responsibility, as well as the reality that serves as a benchmark for the quality of ideal public services within society. Failure to implement Ombudsman recommendations may result in administrative sanctions such as reprimands, reports, or career sanctions like demotion or dismissal. In cases causing state or public losses, violators may face criminal charges if involving abuse of authority. Ombudsman recommendations function as a legitimate, final, and binding corrective instrument in maintaining the integrity of public services.
