A sale and purchase agreement is an agreement between a seller and a buyer in which the seller binds himself to hand over his ownership rights to an item to the buyer, and the buyer binds himself to pay the price of the item. This thesis research aims to find out: (1) The application of the ion system in the implementation of buying and selling according to the Civil Code and the Compilation of Islamic Law and (2) The implementation of the ijon system in duku fruit sale and purchase agreements according to customary law in Ogan Komering Regency Ilir. The research method used is empirical research with a normative legal approach and drawing conclusions inductively. The results of the research state that: (1) The application of the bonded bond system in the implementation of buying and selling according to the Civil Code is permitted because of the principle of freedom of contract in accordance with Article 1338 paragraph 1 jo. Article 1320 Civil Code. Meanwhile, according to Islam, this bonded bond system is included in mukhadarah buying and selling, which is haram and prohibited from being traded. (2) However, the implementation of the bonded bond system according to customary law in Kota Bumi Village is still carried out according to individual beliefs and this buying and selling is permitted and cannot be eliminated because many people believe that this buying and selling has been carried out according to local community customs for generations.
