PERAN NOTARIS TERHADAP LELANG EKSEKUSI MELALUI MEKANISME AGUNAN YANG DIAMBIL ALIH (AYDA) SEBAGAI ALTERNATIF PENYELESAIAN KREDIT MACET
Credit is one of the Bank's products that become one of the factors of economic growth in society. Before providing credit, the Bank first analyzes the debtor and collateral that is guaranteed to avoid problems that can harm the Bank. However, the possibility of bad debt cannot be avoided. So that for bad debt, the Banking Law has regulated the takeover of collateral either through auction or outside the auction. Referring to Article 6 of the Mortgage Law, the first thing is carried out by bank to overcome bad debt is through auction. However, this takes a lot of time and money. So banks prefer to resolve bad debts through non-litigation, namely with the Taken Over Collateral Mechanism (AYDA). In this AYDA mechanism, it is inseparable from the role of the Notary as a Public Official who has the authority to make authentic deeds. Therefore, the problem raised in writing this thesis is regarding the role of the Notary in the Taken Over Collateral Mechanism (AYDA) as an Alternative to Settlement of Bad Credit. This thesis uses normative juridical research supported by field data obtained through interviews at PT Bank BPR Palembang. The results of this study concluded that first, Notaries play an important role in the AYDA mechanism as public officials who are authorized by the Notary Law to make authentic deeds. Notaries also act as Class II Auction Officials because they have the authority to make auction minutes deeds. Second, the authority of Notaries in the UUJN is only regulated as Public Officials who are authorized to make authentic deeds and make auction minutes deeds. Regarding the authority of Notaries in resolving bad debts and the provisions that Notaries can become Auction Officials, this is not regulated in the UUJN Keywords: Bank, Notary, Auction, Foreclosed Collateral, Bad Credit
