PERJANJIAN KERJA SAMA ANTARA BANK DAN NOTARIS DAN IMPLIKASI HUKUMNYA TERHADAP KEMANDIRIAN NOTARIS
A cooperation agreement between a bank and a notary is a form of cooperation that is very important in the process of binding an agreement. The form of a cooperation agreement between a bank and a notary is usually made in written form. A written cooperation agreement is usually in the form of a contract or agreement letter made with the approval of the bank and the notary. The purpose of this study was to determine the characteristic of notary independence and the legal implications for notary independence. In this study, the author used a normative method, namely an analysis of the cooperation agreement between a bank and a notary. The results of the study showed that this agreement could affect a notary independence in making authentic deeds because there were still unprofessional notaries who follow all the wishes of the bank. The legal implications of this cooperation agreement can have an impact on the notary independence, because all actions carried out by the notary must be legally accounted for including all consequences and legal sanctions against the notary. Notary independence must be embedded in the notary so that the notary can have characteristic independent and not side with any party in carrying out his duties the notary must be guided and comply with the Notary Law and the Notary Code of Ethics which have regulated the ethics and notary independence.
