PERLINDUNGAN HUKUM BAGI PEKERJA PADA PERUSAHAAN OUTSOURCING ILEGAL BERDASARKAN PERSPEKTIF HUKUM KETENAGAKERJAAN
The essay entitled “JURIDICAL PROTECTION FOR EMPLOYERS IN ILEGAL OUTSOURCING COMPANY BASED ON THE LEGAL PERSPECTIVES OF WORKING” has been covered with issues on the illegal outsourcing system in Indonesia. Outsourcing is regulated in section 64, section 65, section 66 of the Employment Act and its amendments are regulated by the Labour Creation Act. Among the two (two) regulations equally stipulate that the outsourcing company must be legally competent and have a business permit in establishing an outsource company. The objectives of this research include (1) Studying and analyzing the legal protection of employees in illegal outsourcing companies based on employment law perspectives. (2) Study and analyze the forms of legal liability of companies in illegal externalization against employees based on the employment legal perspective. The research method used is the normative method. Research results show (1) In providing protection for employees to avoid acts of illegal outsourcing companies, the government has made a licensing effort to use Online Single Submission (OSS) to oversee legal and illegal companies in Indonesia. In addition, the Government also imposes sanctions on outsourcing companies that are unlawful regulated in article 515 paragraph. (1). (2) The legal liability of the company outsourcing the case of PT AAJ and CV SMS is examined based on the perspective of the Employment Act and the Law on Creation of Work, then the two companies have different legal consequences according to the rules of their conduct.
