The objective to be achieved in this study are to determine the position and function of the Military Official Residence Occupancy Perm gbit issued by Kodam II/Sriwijaya, what factors cause misuse of the Military Official Residence Occupancy Permit, and how to resolve the problem of the Military Official Residence Occupancy Permit (OP). The method used normatively is an approach taken to analyze about what the extent. A regulation/legislation or law that is currently in effect is effective and supported by interview data from related institutions. The results of the study showed that the position of the Occupancy Permit (OP) for military service housing was as a power of attorney for its holder to occupy and inhabit the land and buildings that are objects of the Occupancy Permit (OP) for military service housing and the factors that influence the misuse of the Occupancy Permit (OP) for military service housing include: a) Strong legal basis for the Military of Occupancy Permit (ROP), b) An unclear time period in the implementation of the Occupancy Permit (OP) for military service housing, c) There was Bad faith from the party receiving the Occupancy Permit (OP) for military service housing, then the resolution of the problem of the Occupancy Permit (OP) for military service housing carried out through litigation and non-litigation by Kodam II/Sriwijaya.
