This thesis is entitled: Application of Criminal Sanctions Against Distributors of Illegal Pharmaceutical Preparations (Decision Study Number: 430/Pid.Sus/2022/PN. Mjk). The formulation of the problem discussed in this thesis is: 1. How are criminal sanctions applied to distributors of illegal pharmaceutical preparations according to the Health Law? 2. What are the judge's considerations in handing down criminal decisions against dealers of illegal pharmaceutical preparations in Decision Number 430/Pid.Sus/2022/PN. Mjk? This research is normative research using a statutory approach and a case study approach. The results of this research show that the application of criminal sanctions in Article 435 of Law Number 17 of 2023 concerning Health has undergone very significant changes, namely that previously the maximum prison sentence was 10 years to 12 years, and the maximum fine of 1 billion rupiah was changed to 5 billion rupiah. Meanwhile, the application of criminal sanctions against distributors of pharmaceutical preparations without a distribution permit which was previously regulated in Article 197 of Law Number 36 of 2009 concerning Health has been removed and is not updated in the new Health Law. Law Number 17 of 2023 concerning Health does regulate distribution permits as stated in Article 143 paragraph (1), but the application of criminal sanctions for violations of Article 143 paragraph (1) is not regulated in Law Number 17 of 2023 concerning Health.
