There are still obstacles in using trademarks as fiduciary collateral in Intellectual Property-based Financing for Creative Economy players. The government has enacted Government Regulation Number 24 of 2022, which strengthens the provisions of intellectual property, particularly trademarks, as fiduciary collateral. This regulation enables creative economy players to use their trademark rights as collateral to obtain alternative sources of funding for business development. The legal issue of utilizing trademarks as fiduciary collateral is only accepted by banks as additional collateral due to the need for supporting regulations for banks to accept trademarks as fiduciary collateral.Based on the above description, the legal issues to be discussed in this thesis are as follows: 1). How is the utilization of trademarks as fiduciary collateral for Intellectual Property-based financing for Creative Economy players?2). How is the regulation of trademarks as fiduciary collateral based on Indonesian laws and regulations?, and 3).What are the ideas for regulating trademarks as fiduciary collateral for Intellectual Property-based financing for Creative Economy players in the future? The purpose of this research is to analyze the utilization of trademark rights, the regulation of trademark rights as fiduciary collateral, and the ideas for regulating trademarks as fiduciary collateral for Intellectual Property-based financing for Creative Economy players in the future.This makes it distinct from previous writings. This research uses normative legal research methods with the aim of producing new arguments, theories, or concepts as prescriptive solutions to the problems faced. The approaches used include legislative approaches, analytical approaches, and futuristic approaches. Legal material analysis is carried out qualitatively, and conclusions are drawn deductively. The research results show that trademarks as fiduciary collateral must be registered with the Directorate General of Intellectual Property of the Ministry of Law and Human Rights. The trademark products must be well-managed either independently or the rights have been transferred to others. This regulation still requires structured technical regulations to ensure the implementation of intellectual property can be carried out, providing legal certainty not only to financial institutions but also to creative economy players.
