REKONSTRUKSI PENGATURAN HAK WARIS ANAK LAKI-LAKI DAN PEREMPUAN BERAGAMA ISLAM BERDASARKAN NILAI KESEBANDINGAN
Article 176 of the Compilation of Islamic Law adopts the Qur’an Surah An-Nisa, verse 11 regarding the inheritance share ratio of two to one for male and female children. However, this was not the case in several rulings by religious courts that have determined equal shares for both. The objectives of this study are: (1) to identify and examine the nature of the status of male and female heirs in Islamic inheritance law. (2) to identify and analyze the authority of judges in resolving inheritance cases involving male and female children in Indonesian Religious Courts. (3) to discover and formulate a reconstruction of the regulation of inheritance rights for male and female heirs according to Islamic inheritance law in relation to the concept of national inheritance law. This research was normative in nature and constitutes library research. The sources of legal materials used were primary legal materials, secondary legal materials, tertiary legal materials, and non-legal materials collected through libraries and the utilization of information technology. The findings of this study are: First, the nature of the status of male and female heirs in Islamic inheritance law is equal as heirs as stated in Qur’an Surah An-Nisa, verse 7. However, based on Surah An-Nisa, verse 11, the share ratio is two to one, because of the correspondence between rights and responsibilities (obligations) borne by male and female children. Second, judges have the discretion to adjudicate inheritance cases involving male and female children based on the principles of balanced justice and responsibility, which consider the equilibrium in the fulfillment of obligations by male and female children. Third, the reconstruction of the regulation of inheritance rights for male and female heirs within the national inheritance law concept in the future is to reconstruct the inheritance shares of male and female heirs in Islamic inheritance law in Indonesia based on the values of proportionality and the principles of balanced justice and responsibility by reformulating the content of Article 176 of the Compilation of Islamic Law.
