AKTA PERJANJIAN PENGIKATAN JUAL BELI (PPJB) SEBAGAI PROSES PERALIHAN HAK ATAS TANAH YANG DIBUAT OLEH AHLI WARIS
Land is one part of the natural resources on earth that is very vital for all life on earth, especially for humans. Land sellers or developers often use a binding agreement (PPJB) for the sale and purchase transaction which serves as an advance payment from the buyer. However, sellers are often not clear in buying and selling land, such as the case of Court Decision Number 51/Pdt.G/2022/PN.Kla Negri Kalianda where the buyer sued the seller because the land purchased had a land certificate that had not been broken, because the original owner had passed away and there were heirs who did not make a sale and purchase agreement. This research aims to find out the legal regulations of PPJB made without the consent of one of the heirs. Analyze the law enforcement of buyers who buy and sell land. Analyzing legal remedies for buyers who cannot process the transfer of land rights. This research is a normative juridical research using a legislative aPProach, case aPProach, and sociological aPProach. The results of the research describe that the Sale and Purchase Agreement (PPJB) cannot be the basis for transferring land rights if the land is still part of the inheritance and there has been no legal division of inheritance among the heirs, because the land is still a joint right of all heirs and the transfer of land rights can only be done after the division of inheritance is carried out legally. Legal enforcement of good faith buyers of the seller's legal defects heirs, buyers are entitled to claim compensation for losses incurred based on Article 1365, Article 1320, and Article 1338 of the Civil Code. efforts to obtain signatures or consent from heirs who have not signed the PPJB, Making PPJB again by presenting all heirs for signatures, can be done through communication and mutual agreement between the parties involved. The need for a regulation that provides clarity from the problem of buying and selling land, especially with regard to heirs, law enforcement for buyers of inherited land disputes.
