PENERAPAN VIENNA CONVENTION ON DIPLOMATIC RELATIONS 1961 DAN HUKUM NASIONAL ATAS TINDAK PIDANA PELECEHAN SEKSUAL YANG DILAKUKAN OLEH ANGGOTA CORPS DIPLOMATIC
This research discusses cases of sexual harassment committed by members of the Diplomatic Corps who abused their diplomatic immunity. This research aims to explain and analyze the regulations of International Law and Indonesian National Law in law enforcement against perpetrators of sexual harassment committed by the Diplomatic Corps. This research was conducted using a normative method that examines the statute approach, conceptual approach, and comparative approach by examining statutory regulations related to the problem according to the case being studied. This research resulted in the provision that in diplomatic relations, the states involved are obliged to always respect the jurisdiction of the receiving state. The existence of a dispute that occurs due to the abuse of diplomatic immunity then requires the states concerned to always cooperate in accordance with applicable international law and national laws in both the receiving and sending states so as to produce legal consequences in the form of responsibility for both the perpetrator of the criminal act and the state’s responsibility for both perpetrators as well as the protection of victims.
