ASPEK HUKUM PENYANDERAAN PILOT SUSI AIR DI PAPUA DITINJAU DARI HUKUM HAK ASASI MANUSIA INTERNASIONAL
This thesis is entitled “Legal Aspects of the Hostage Taking of Susi Air Pilots in Papua in View of International Human Rights Law”. The author on this study examines protection of civilians in armed conflict, particularly in hostage-taking cases involving Susi Air pilots in Papua based on International Human Rights Law on the protection of civilians. The author raises 2 (two) issues in this research, which is first, aspects of human rights law governing the hostage-taking of Susi Air pilots; second, state responsibility for the protection of civilians in areas of conflict. This research produces 2 (two) results; First, the hostage-taking of the Susi Air pilot in Papua is contrary to International Human Rights Law and violates several articles of the Geneva Conventions governing the protection of civilians in times of war and the Universal Declaration of Human Rights governing the basic rights of individuals without exception; Second, the hostage-taking of Susi Air pilots who are civilians and foreign nationals residing in Indonesian territory gives rise to the state's responsibility to protect civilians. The Indonesian government has the primary responsibility to protect civilians from hostage-taking and to ensure that hostages are released safely and perpetrators are brought to justice in accordance with the law.
