PERTANGGUNGJAWABAN PELAKU TINDAK PIDANA PENGEDARAN SEDIAAN FARMASI TANPA IZIN EDAR MENURUT UNDANG-UNDANG NOMOR 36 TAHUN 2009.
Pharmaceutical preparations, namely drugs that meet the standards and the quality, must have an official permit that is validly distributed by the food and Drug Control Agency, the Health Service, as well as the institutions authorized for health, especially Narcotic and psychotropic drugs, which may not be sold freely but must be with doctor’s prescription and has a distribution permit. This study discusses: a) what is the accountability of the perpetrators of the criminal act of distributing Pharmaceutical preparations without a distribution permit; and b) what are the criminal law policies in the future for the distribution of pharmaceutical preparations without a distribution permit. Based of the results of the study with a normative research method, it is concluded that: a) criminal liability is committed by a person or human or legal entity for committing a crime against the law based on mistakes, namely intentional (opzet) and negligence (culpa). The committed criminal acts are based on Case Studies of the Supreme court of the Republic of Indonesia based on Principal Case, the Public Prosecutor’s Indictments, Criminal Charges, Judges’ Considerations, Rulings on Decisions, and Basic Analysis of Judges’ Considerations in Imposing Criminal Sanctions; and b) legal policies that will be carried out in the future based on a policy (penal policy) in the form of Material Criminal Law Politics, Formal Criminal Law Polities, and Implementation of Criminal Law.
