PELAKSANAAN PENGADAAN TANAH UNTUK PEMBANGUNAN JALAN TOL TRANS SUMATERA DENGAN OBJEK TANAH KAS DESA (STUDI PENGADAAN TANAH DI KECAMATAN MESUJI RAYA KABUPATEN OGAN KOMERING ILIR).
This study was aimed at explaining the Implementation of Land Procurement for the Development of Trans-Sumatra Toll Road with the Object of Village Treasury Land (A Study of Land Procurement in Mesuji Raya District, Ogan Komering Ilir Regency). Land procurement is a government effort to acquire land for various development purposes, especially those serving public interests. This study used a statute approach, case approach, and futuristic approach. The research findings affirmed that the process of land procurement for public interests, based on Article 2 of Law No. 2 of 2012, consists of four stages: (1) Planning Stage, (2) Preparation Stage, (3) Implementation Stage, and (4) Delivery Stage. These four stages are inherently intertwined with the involvement of various stakeholders and community participation. In the procurement of village treasury land affected by the construction of Trans-Sumatra Toll Road, the compensation for land losses is provided in the form of monetary compensation. This compensation is subsequently allocated as a part of the village treasury. Meanwhile, the compensation for village treasury land that has not yet obtained replacement land for public interests can be provided in advance in the form of monetary compensation, as stipulated in Article 75 (1) of Presidential Regulation No. 71 of 2012 regarding the Implementation of Land Procurement for Development for Public Interests. Moreover, the Minister of Home Affairs Regulation No. 1 of 2016 stipulates that village treasury land can be transferred through a barter mechanism under the following conditions: (1) when it is required for public interests; (2) when it is not required for public interests; (3) apart from for public interests and not for public interests. Therefore, the process of compensating village treasury land for public interests must prioritize the principle that benefits the village with fair compensation values.
