Land is one of the absolute and vital human needs. Human life in the world is inseparable from the land, in other words, it is difficult for humans to live without land. In this study discusses two formulations of problems which include: How is the process of acquiring land for private housing development by PT. Garuda Emas Cakrawala, How obstacles and solutions faced by PT. Garuda Emas Cakrawala in acquiring land for private housing development, as well as how to arrange land acquisition in the future for private housing development. The purpose of this study is to analyze the process of acquiring land for private housing development at PT. Garuda Emas Cakrawala, to analyze the obstacles and solutions faced by PT. Garuda Emas Cakrawala in acquiring land for private housing development, to analyze future land acquisition arrangements for private housing development. This study used normative legal research. The result of this research is land acquisition activities carried out by PT. Garuda Emas Cakrawala is through the release of land rights by land rights holders through a process of deliberation and compensation. the existence of a third person who wants to use land owned by residents who will be affected by the acquisition to make a profit for themselves, Many landowners do not have certificates or other title letters over and often it happens that two / more people who claim to be owners of the same piece of land are obstacles faced by housing developers But these obstacles are resolved through deliberation with landowners and checking legality regarding the validity of community land title certificates at the National Land Agency of Palembang City. There is an urgency to create a law or legal regulation regarding procedures for releasing land rights for housing developers which explains the mechanism for obtaining land rights through relinquishment and steps that can be taken in dealing with problems or potential conflicts that arise during the process of releasing land rights.
