PENUNDAAN KEWAJIBAN KONTRAK INTERNASIONAL PENGANGKUTAN BARANG JALUR LAUT AKIBAT PANDEMI COVID-19 BERDASARKAN HUKUM INTERNASIONAL.
This research analyzed the role of international law in resolving problems in contracts for the carriage of goods by sea due to the COVID-19 pandemic. This was normative legal research by analizing library research. The problems discussed in this research were international legal instruments that regulate international contract for the carriage of goods by sea and its problems during the COVID-19 pandemic and also to give the solutions for delays in sea transportation contract due to the pandemic. The research result obtained that transportation of goods by sea is specifically regulated in The Hague Rules 1925 and Hamburg Rules 1978, followed by international trade which is regulated in the UNCTAD, UNIDROIT, and ICC. The main result of the pandemic is the delay in carriage of goods by sea that caused delays in the loading of goods to the recipient which affected loss to both parties. The carrier use the force majeure clauses as an excuese to avoid liability for losses. To guanrantee the safety of goods is by using marine cargo insurance, renegotiate contracts is an option to avoid cancellation of contracts, also arbitration as non-litigation way is used solve international contract disputes.
