KEDUDUKAN ANAK SEBAGAI AHLI WARIS YANG DURHAKA TERHADAP ORANG TUANYA UNTUK MENDAPAT HARTA WARIS DI TINJAU DARI HUKUM ISLAM.
This thesis is entitled The Position of Children as Heirs Who Disobey Their Parents to Get Inheritance in Review of Islamic Law. In the background because in Islam children are taught to do good, polite, and respect towards parents, but in fact there are still many children who behave badly by disobeying their parents so that it can have negative consequences in the relationship between the two in this case related to the transfer of wealth from heir to heir. The issues discussed in this thesis are: 1. What is the position of children as heirs who disobey their parents to get inheritance in terms of Islamic law? 2. What is the inheritance status of children as heirs who disobey their parents according to Islamic law? This research is a type of normative research. The results of this thesis discussion can be concluded by the author that 1. The position of the child who disobeys his parents still remains as an heir who has the right to inherit property, in Islamic inheritance the heir who is entitled to inherit is motivated by the existence of nasab or blood relationship not because of the child's obedience to his parents as in Article 173 of the Compilation of Islamic Law which states the obstruction of the heir not getting the inheritance property because he is blamed for killing or trying to kill by committing a crime severely persecuted the heirs. 2. Regarding the status of inheritance of an ungodly child in the right to inherit property, it is still legal for the ungodly child to obtain it, because this is said to be an act of lawlessness not a form of loss of the right of heirs to get inheritance, but which is the cause of the loss of the right to inherit property in Islamic inheritance, namely because of different religions or apostasy, death, Slave status, and Al Hajb.
