The European Union's 2015 migration crisis has become an issue that connects a wide range of policy concerns, from fears of terrorism to economic well-being, border control, identity issues, and responsibilities for all EU member states, affecting member states in different ways, with varying responses, the wave of migrants continued along with the uncertain security conditions of countries in the Middle East due to political crises and also threats to the economy of refugees, especially from conflict-affected countries, forcing refugees to leave their home countries due to difficulties in their home countries. In this research, Hungarian as state is focus in dealing with refugees who cross its borders with the existence of the Charter of Fundamental Rights of the European Union which aims to unite the basic rights of everyone living in the European Union, and the impacts that arise due to non-compliance with the objectives of the charter and the consequences that occur seen in the case of refugees at the Hungarian border. By using a qualitative method to analyze the form of Hungary's compliance with the international regime of the Charter of Fundamental Rights of the European Union based on the case of refugees at the Hungarian border, using the concept of compliance with the indicators of thought by Ronald B. Mitchell : Outputs, Outcomes and Impact to classify Hungary's level of compliance, which is Active non-compliance as evidenced by the Hungarian government's responds that does not comply with implement the commitments and rules that have been mutually agreed upon in carrying out the international regime, however, Hungary's response is to provide other alternatives in solving the refugee problem in it’s country.
