This thesis is entitled "Fair Legal Certainty in Providing Rehabilitation by Integrated Assessment Team for Narcotics Users Conducted on Pre-Adjudication Study Stage of the National Narcotics Agency of South Sumatra Province". The study was carried out because the rehabilitation provision by writing of this thesis in the background providing rehabilitation by the integrated assessment team had to be made through a judge’s decision in advance for having the rehabilitation of narcotics users; yet, viewed from the time of rehabilitation provision, it took a long time and inefficient that caused the level of addiction could not be processed quickly. This resulted in problems to be addressed, namely: (1) what criteria for giving rehabilitation recommendation for narcotics abusers in narcotics rehabilitation institutions by the National Anti Narcotics Agency, (2) what obstacles faced by the Narcotics Agency Integrated Assessment Team in South Sumatra Province in the process of formulating rehabilitation recommendation, and (3) how the legal certainty in the provision of rehabilitation by the integrated assessment team for narcotics users conducted in the pre-trial phase. The result method used was empirical juridical. The research results showed that the criteria for providing rehabilitation recommendations could be seen from the examination of legal history, history of narcotics use, alleged legal status and network tracking. The constraints faced the integrated assessment team was that the Integrated Assessment Team Recommendation Letter was only a recommendation, differing views among the integrated assessment team members, the difficulty in inviting the integrated assessment team to carry out the rehabilitation examination, and inadequate infrastructure and facilities. The Legal certainty in the provision of rehabilitation is regulated in Article 54 of Law Number. 35 of 2009, Joint Regulation Number: PERBER/01/III/2014/BNN, Presidential Regulation Number 23 of 2010.
