PERBANDINGAN HUKUM AKAD PEMBIAYAAN KEPEMILIKAN RUMAH BERDASARKAN PRINSIP SYARIAH TANPA BANK DAN DENGAN BANK
The implementation of sharia home ownership financing contract still has obstacles that must be solved, namely when consumer establish cooperation either without a bank or with a bank, the financing contract must be free from elements of usury and based on sharia principles.the problems in this are how the legal constructions, installment implementation procedures, and the benefits and losses for parties in a home ownership a bank at Bank Syariah Indonesia (BSI) KCP Sukodadi. a normative research method was used with primary, secondary, and tertiary legal data. the result in this study show that the legal constructions of home ownership financing contract based on sharia principles without a bank in a Grand Oase Village and with a bank BSI KCP Sukodadi are both sourced from the contracts. the type of contract used without a bank in Grand Oase Village is an istishna contract and with the bank at BSI KCP Sukodadi is a murabaha contract. the procedure from installment of sharia mortages without a bank an Grand Oase Village has some stages, namely the prospective buyer submit an aplication, creates a contract, pay the booking fee, and dwon payment, and pay the installment, while the stage installment with the bank at BSI KCP Sukodadi are almost the same. the different stages of the latter procedures are BI checking, collateral assessment and 5C analysis. the advantages of both types is for avoiding rule of the community and these regulations play a role as guidance for legal problems that might occur.
