DINAMIKA NEGOSIASI INDONESIA-EU CEPA DALAM KONTEKS PENGADAAN BARANG JASA PEMERINTAH
The research aims to analyze the dynamics of the Indonesia-European Union Comprehensive Economic Partnership Agreement (I-EU CEPA) negotiations in the context of Government Procurement of Goods/Services (GP) which have been ongoing for 15 rounds over 8 years until July 2023. The qualitative research was conducted using data collection techniques through observation and interviews with LKPP as Indonesia's lead negotiator in the IEU CEPA GP Chapter, based on the principled negotiation theory proposed by Roger Fisher and William Ury. The research findings indicate that the dynamics of the IEU CEPA negotiations in the GP Chapter face challenges of position bargaining, perceptions of victory for one, and imbalanced power between Indonesia and the European Union. To overcome these challenges, the following steps were taken: 1. Interest-Based Negotiation through joint study, scoping paper, proposed draft text, and SoD, where both parties still tend to engage in positional bargaining; 2. Creation of Creative Options through the development of positions based on studies and analysis, and remaining open to considering benefits in other chapters despite facing victory for one perspective challenges; 3. Determination of Objective Criteria involving the application of standards of suitability for options with domestic regulations, cross-chapter alignment, and long-term impact analysis. Fair criteria are applied equally to the main body and the reciprocal principle in the annex section, and evaluated using the penta-helix approach; 4. Best Alternative to a Negotiated Agreement could not be fully operationalized in this research, but as a suggestion, Indonesia can diversify markets and trading partners, enhance bargaining power through regional cooperation, and improve competitiveness and product quality.
