PENERAPAN DOUBLE TRACK SYSTEM TERHADAP PENDERITA GANGGUAN JIWA SKIZOFRENIA YANG MELAKUKAN TINDAK PIDANA PEMBUNUHAN
This study is entitled Application of the Double Track System for Patients of Schizophrenia who commit murder. In the provisions of Article 44 paragraph (2) of the Criminal Code judges can order criminals with mental disorders to be admitted to a mental hospital for a maximum of 1 (one) year. However, in the Judge's Decision Number: 94-K/PM.II-09/AD/V/2016 he was given a prison sentence. In another Judge's Decision Number: 144/Pid.B/2014/PN.C, the judge decided that the defendant sent to prison in a mental hospital for 3 (three) months. There were differences in the imposition of punishments for criminals with mental disorders. Based on this context. The study tries to analyze (1) how the double-track system is regulated in the Indonesian criminal system, (2) how the double-track system is implemented through Decision Number: 94-K/PM.II-09/AD/V/2016 and Decision Number: 144/Pid.B/ 2014/PN.Cj and (3) what is the concept of a double-track system for criminals with schizophrenia in the future? This research uses the juridical-normative research method and employs the statute, conceptual and case approaches. The results show that (1) the regulation of the double track system in the current Criminal Code has clarified the arrangements in the new Criminal Code; (2) the implementation of the double track system for perpetrators with a schizophrenic mental disorder can be seen through Judge's Decision Number: 94-K/PM.II-09/AD/V/2016 and Judge's Decision Number: 144/Pid.B/2014/PN. Cj; and (3) the implementation of the double track system against perpetrators with schizophrenia in the future can be applied by judges after considering the recommendations of psychiatrists at trial.
