KETIDAKHARMONISAN UNDANG-UNDANG NO. 30 TAHUN 2004 DENGAN UNDANG-UNDANG NO 37 TAHUN 2004 TERHADAP NOTARIS YANG DINYATAKAN PAILIT (Studi Putusan Pengadilan Niaga Pada Pengadilan Negeri Surabaya Nomor 20/Pdt.Sus-PKPU/2020/PN Niaga Sby)
This research is entitled 'Inconsistency between Law No. 30 of 2004 and Law No. 37 of 2004 on Notaries Declared Bankrupt'. The regulation on bankruptcy according to Article 12 letter a of Law No. 2 of 2014 concerning the Position of Notary causes many different interpretations, and the article imposes a penalty on Notaries by terminating them dishonorably if they have been declared bankrupt by. a court decision. Such dishonorable termination is not in line with the concept of bankruptcy as regulated in Law No. 37 of 2004 concerning Bankruptcy. The purpose of this research is to determine and analyze how the regulation of bankruptcy applies to Notaries based on Law No. 2 of 2014 concerning the Position of Notary and Law No. 37 of 2004, as well as the legal consequences for Notaries declared bankrupt. This research is a normative legal research using a legislative and conceptual approach. Data were collected from primary and secondary legal materials and analyzed using a qualitative descriptive method. The results of this study show that the regulation of bankruptcy for Notaries based on Article 12 letter a of the Law concerning the Position of Notary does not allow for dishonorable termination from their position. Notaries are considered legal subjects who represent individuals with debts. The legal consequence of a bankrupt Notary according to the Bankruptcy Law only results in losing the right to dispose of their wealth, but not the right to practice their profession and hold their position. It is recommended that the government create regulations to review the contents of regulations on bankruptcy for Notaries to avoid multiple interpretations.
