The purpose of this research is to analyze the regulation of Instrumental Witnesses in maintaining the confidentiality of the contents of notarial deeds and to analyze the legal protection that can be given to instrumental witnesses in maintaining the confidentiality of the contents of notarial deeds. This research is a normative study using an approach based on laws, philosophy, scientific works, books, and journals related to the research theme. This study uses primary, secondary, and tertiary legal materials. The obligation to maintain the confidentiality of the contents of notarial deeds is essential to protect the legal interests of the parties involved. However, the current regulations do not regulate and accommodate the situation, resulting in a legal vacuum and ambiguity regarding the duties and obligations of an instrumental witness involved in the process of making a notarial deed when faced with a situation to disclose the contents of the deed. The results of this study confirm that changes are needed in the Notary Law, accompanied by the making of implementing regulations to provide legal benefits and enable binding legal certainty. Legal protection for instrumental witnesses is also necessary to maintain the dignity and reputation of the notary profession. Without current regulations regarding instrumental witnesses, there will be a legal loophole that can be exploited by investigators in the process of resolving criminal acts to seek witness statements without regard for the dignity of the notary profession.
