PENOLAKAN EKSPOR CRUDE PALM OIL INDONESIA KE UNI EROPA BERDASARKAN RENEWABLE ENERGY DIRECTIVE (RED) II
This research is entitled as “Refusal of Indonesian Crude Palm Oil Export Based on Renewable Energy Directive (RED) II” with some core problems that being addressed in this research such as the aspects related to the international trade that connected with the export and import of Indonesian Crude Palm Oil (CPO) to European Union, what are the reasons of Indonesian CPO being rejected by European Union, and what are the solutions that Indonesia can do to cope those problems. This research is normative legal research by analizing of primary, secondary, and tertiary legal sources. The discovery of some several obstacles from the implementation of RED II and Delegated Act regulations such as the gradual limitation on CPO by making an exclusion and eliminating the deduction of palm oil or CPO-based biofuel taxes. The Uropean Union claimed that these actions are taken due to the condition of CPO that has been categorize as a high Indirect Land Use Change (ILUC) plantation. Related to this issue, Indonesia has tried to make some actions by improving the quality of Indonesian CPO and industrializing the comodity to become a national biofuel product. In additions Indonesia should make a joint champaign and open a new global market with other countries to promoting and affecting the international trade of Indonesia CPO.
