Business competition is one of the economic instruments in the development of the economic system in Indonesia, this is indicated by the issuance of Law Number 5 of 1999 concerning the Prohibition of Monopolies and Unfair Business Competition. According to information obtained by the author from interviews with several counter business actors who sell smartphones in the PALI Regency area,there was one smartphone stall in the penukal sub-district setting a lower price than the brochure stipulation from the smartphone company. This indicates the existence of unfair business competition in prohibited activities (predatory pricing)as stated in article 20 of Law No. 5 of 1999 concerning the Prohibition of Monopoly and Unfair Business Competition practices. The problems discussed in this study are 1)is the price setting for smartphone salles in the PALI regency area considered as the predatory princing category in law no. 5 of 1999?:2) 2) What is the impact of price fixing in unfair business competition on smartphone sales for other similar business actors in the PALI Regency area?, 3) How to create fair business competition created in smartphone sales in PALI Regency? this is an empirical research using article article 20 regarding predatory pricing, a case approach, and a contextual approach. The results of this study showed that the setting of samrtphone prices in the PALI regency area in the sales of oppo (a smartphone brand) by vika call, a smartphones stall business actor, was suspected of having carried out predatory pricing, setting the smartphone price below the brochure price. The impact of predatory carried out by business actors would cause competing business actors to experience a decrease in sales and new business actors found it difficult to enter the smartphone sales market in PALI Regency. In order to realize fair business competition, business actors are required to exercise their rights and obligations to comply with regulations related to the prohibition of monopoly and unfair business competition practices by competing fairly.
