Indonesian criminal law, especially those contained in the Criminal Code, are based on historical, political and sociological reasons. It is necessary to reform (supporting the concept of the new Criminal Code), this takes into account the legal values that live in society. Such an understanding should be the basis for consideration in discussing the perpetrators and victims of the crime of rape. In line with the basic considerations in this thesis with the theme of juridical analysis of the application of article 12 paragraph (4) of the Criminal Code in the case of the crime of rape, the issues to be discussed are: (1) What are the considerations of the Public Prosecutor in carrying out prosecutions, (2 ) How is the application of article 12 paragraph (4) of the Criminal Code in the letter of demand for the Public Prosecutor, (3) how will the prosecution in the future of the same case be in accordance with the national legal system in the future. This research is a type of normative juridical law research. namely through research by means of library research and the approach to legislation in the form of documents, books, laws and regulations and other materials related to the problem under study using the statutory approach ((Statute Approach) and socio-economic approach. Legal (Socio-Legal Approach) The results of this study aim to obtain a clear picture of the criminal law review of the crime of rape and what factors are considered by the Public Prosecutor in carrying out the prosecution of the crime of rape in the Lebak District Attorney's jurisdiction. using qualitative data analysis with interactive models.Based on this research, it can be concluded that the review of criminal law on the crime of rape that occurred in the Lebak District Attorney's Office.The results of this study indicate that the position and criminal arrangements in the crime of rape are strictly regulated in the criminal arrangement in article 285 of the Criminal Code, but the criminal refers to article 12 paragraph (4) of the Criminal Code, besides that the formulation of the form of criminal threats that exist at any time may not exceed 20 years, while in the position of setting criminal sanctions using an accumulation system.
