LEGAL PROTECTION TO VICTIMS OF SEXUAL VIOLENCE IN THE DISABILITY IN THE CITY OF PALEMBANG
ABSTRACT Sexual violence is a problem that needs special attention, especially the cases involving children with disabilities as victims. The cases against children with disabilities are often stopped due to lack of evidence, absence of witnesses, and insufficiently convincing testimony from the victim. This study raises the issue of legal arrangements and protection for victims of sexual violence occurring to children with disabilities in the city of Palembang. The objective of this study is to disclose legal arrangements and efforts to provide legal protection for the victims of sexual violence occurring to children with disabilities in the city of Palembang. This study is an empirical juridical study using related literature and field research materials. The approaches used are statutory approach and empirical sociological approach. The results of this study reveals that there has not been any law that specifically regulates the provision of sanctions and also legal protection for children with disabilities as victims of sexual violence. The obstacles encountered are the obstacles of legal substance factors related to laws and law enforcement officers. The effort to fulfill the protection of children with disabilities through legal substance efforts is by making regulations that specifically regulate legal protection for victims of sexual violence against children with disabilities, and the involvement of parties, both law enforcement officers and related institutions, as well as the wider community is urgently required.
