In the case of traffic accidents, the efforts to settle cases out of the court are based on the Restorative Justice approach. Such cases are also carried out at the Palembang Polrestabes Resort that are regulated based on Police Regulation Number 8 of 2021 concerning the handling of criminal acts based on restorative justice. The method of study used in this study is a normative juridical study method supported by empirical data. In its implementation, the Palembang Polrestabes encountered problems with stopping the initial investigation and investigation of traffic accident cases through Restorative Justice, namely due to, firstly the reluctance of witnesses to be questioned by initial police investigators in the initial investigation due to fear of dealing with the law, and secondly, the victim took too long to report traffic accidents experienced so that evidence is lost. The ideal setting in the future in dealing with the challenges of traffic accident cases in the settlement through Restorative Justice is that it is necessary to make changes to the settings in the Criminal Procedure Code regarding the addition of regulations that the settlements with traffic accident cases must be sought through Restorative Justice which has been in effect since the stage of initial investigation and investigation by the Police, at the stage of prosecution at the Prosecutor’s Office, and at the stage of examining cases at the Court, with certain conditions. This is needed because the settlement through Restorative Justice in traffic accident cases is currently only limited to the level of initial investigation and investigation in the Police.
